Porn Industry Threatens Suit Against “XXX” Music
Ever since Shooter Jennings proposed labeling music that is too rock for country, and too country for rock with the letters “XXX”, the issue has been heated in some circles, causing conflict and turf wars amongst country and roots music’s underground and independent entities. Now “XXX” music has drawn the ire of a new foe, America’s $14-billion dollar-a-year pornography industry.
“I didn’t bang a whole South American soccer team just to have some stupid, no-name musicians come steal my thunder”, says Alexxxis Stardust, star of such pornography films as Cougars in Heat #4, Couples Bang the Babysitter, and Lez Stravaganza #12. “I mean maybe if they were actually good musician’s like Ke$ha or Kanye West I’d be like ‘Hell yeah, let’s party!” But these are just a bunch of gross boring people who play stupid music and probably let their pubes grow wild.
Porn industry spokesman Charles Frankenfurter took a more somber approach to the possibility of legal action against XXX, the music version. “We believe this is a serious matter, and that there could be legal ramifications involved. Think about it, go up to anybody on the street, anybody, mention the letters ‘XXX’, and ask them what they think of. How many do you think will say ‘music’? I guarantee you, 99 out of 100 will say ‘porn’, and the 1 will be Vin Diesel’s mother.”
Frankenfurter says the matter comes down to respect. “Of all things, why name to music something that is already established, unless your plan is to profit off of the work others have already done? Why not start your own thing from scratch, like we did? Why must you start by robbing from others?”
Charles Frankenfurter says he also doesn’t want the pornography consumer confused.
“What if someone goes looking for porn, and accidentally stumbles on to this music? We don’t want music representing what we do, it could give us a bad image. The industry is already hurting from the infiltration of amateurs into the business, and the digitization and bootlegging of intellectual property. Now we have to get in a naming-rights battle with music in the midst of an identity crisis.”
Sources tell Saving Country Music the porn industry is planning to launch a website: “givemebackmyxxx.com” to counter music’s “givememyxxx.com”, as well as start an online petition.
“They better respect our turf!” threatens Alexxxis Stardust. “I know a lot of soccer players who aren’t afraid to get rough, and I mean, a lot!“

I think you would probably do best by not always naming other people in posts you do. It seems you make alot of people angry by naming names and putting words in their mouth. If you have something to say by all means say it, but don’t attach other people to what you are saying. I know you and Shooter share alot of ideas, so you two mention each other all the time. But after everything I read on the thread you mentioned above, I would probably leaves Keith’s name out of anything you say. Let him speak for himself.

sure, I apologized after it all, because in that post you also stated we would discuss a name change, which prompted my apology for posting that in your yard, not so much the post! I work collectively with the community as much as possible, so I don’t want that “work out amongst ourselves” to read wrong to anybody. That means I will share some thangs with Triggerman, or whomever I see fit.
Hats off to you Trig for raising awareness in a “nice” atmosphere. Im sure there is a blend of both of our methinds to hopefully work on this name change issue. That being said, headquarters is working up our official & final response (for now) to this matter, to also raise awareness to those those ready to accept.

Ok, So for the most part we all agree that the music being promoted by all parties involved is the music we all want to hear. But instead of letting the subject go its own way (as I believe you suggested you would do) you put a new flame under it. Its fine if its humerous, but can you see the negative vibe you brought back to XXX. I know thats the point THE NAME, Who really give’s a shit about the name. The more outlets the better. Why would you bring it back to your spotlight in a negative fashion when you stated…

I agree with you. I can see the humor in this, but this should have been written 5months ago, not when the XXX debate has died off and those that really need to hash out the name are doing so.
Sounds to me that Trigger may have been left out of some discussions others were having about best direction/name to go with, so to get in the mix, he tossed this out.
I have said before, and will say agian, Trigger won’t take a stand on lighting rod topics. XXX, J. Johnson. He claims the “jury is still out”, but he also takes shots like this at them that he justifies as “just a joke”.

As a former straight edge Hardcore kid, I would like to second the motion to file a suit against XXX. Or maybe we could all just settle the matter out of court, in a pit someday. If this matter goes to court, we will be filing a class-action lawsuit on behalf of all New York, DC, NJ, and Cali hardcore kids. I don’t think anyone understands the stress this puts them under. Some have been awaken in the middle of the night with terror sweats, after having Nightmares of Jonah Hill molesting them.
Also I will be filing a protection order against all of those with stick-in-ass disorder. Their humorless nagging will not be allowed within 500 feet of a school or a website comments section.

For starters, I thought this article was humorous… But I still cannot figure out why SO many people have a problem with XXX. I hit their site every so often and check out new bands. What is wrong with that? Even if certain artists are left out people will be more apt to learn of them one day thanks to XXX and sites like SCM. It’s a good thing.

What “so much music” that isn’t being covered here? And how do you define “coverage”? Throwing up an album cover on a website without permission from the band, or writing in-depth reviews, interviews, news, and human interest articles about them? Hell, SCM logos are all over that website, and I’ve asked them formally 5 times to take them down. They have a Hank III album up there he’s asked people not to buy, while there’s a full-on boycott of Curb Records in place.
On No Depression Adam Sheets said that “most” XXX bands were not covered on this site, then offered a list of 27 bands. 17 of those bands I have covered in-depth at one time or another, and only 5 I had never mentioned. After pointing this out, Adam Sheets never apologized or responded to the blatant mischaracterization of this website. If this is all about “working together” as you keep bringing up, why take shots at SCM, especially ones that are clearly false? Would you say my coverage of bands is paltry? Has SCM covered bands that XXX hasn’t? I’ve written over 1000 articles. I sped 50 hours a week on this website. To somehow characterize that SCM is not carrying its weight is insulting. I put my “coverage” of bands up against XXX any day, seeing how for some reason they continuously want to pit me against them.

I don’t think anyone will ever be completely happy with the coverage that any site offers. Their is always going to be great, yet obscure bands left out. You do a great job of exposing us all to new music, which is why we are all on here every day. But every little bit helps as-far-as I am concerned. And all of the in-fighting between the parties involved doesn’t mean shit to me. I am just glad to see Shooter start to recognize that there is a country underground, cause for years I’d listen to his radio show and seldom hear anything that I didn’t already know of – this was before I discovered SCM. XXX is helping some of these bands to get a better foothold which means that maybe I will get to see some of them live at somepoint, and that’s what really matters to me. I don’t live in the south, so good shows are few and far between..

The XXX Website reads under the big XXX – “XXX Artists and Albums to check out”
Amanda Shires, Possessed by Paul James, Left Lane Cruiser, Hank3, Reverend Peyton’s Big Damn Band (who’s pictured album is like 3 releases ago) are NOT XXX artists, not ONE of these albums are XXX albums. Adam’s & Shooters approach to be relevent is informing people that they were/are a part of something they are not. Really…”XXX Artists & Albums”??? Now I get to have PPJ referenced with words & instrument tunes that say “I’ll slip out of your daughter, like I’ll slip out of your noose”…just wonderful.. Like I said since day 1, XXX is an anchor to our community. It does matter, it is relevent, and if XXX wants to say “Look at us”, then SOMEONE has to address it, whoever they may be. We are being as humble as we can too. If folks continue to do things the way THEY see fit, then so will HB (like we have since day 1). It is discouraging that XXX is portraying simple no no’s in the business. Simple no no’s being showing folks that you are something you are not via perception. That being said, we are releasing our final statement concerning this matter. It’s ready to go…. just building up the momentum to post it. Aside that, there is TONS copywright issues concerning their site (XXX Artists & Albums) and it would take 1 call to their registered agent to have their site takin down. On SCM, they give links, write-ups, information & opinions… XXX just slaps up pictures with only “XXX Artists & Albums” for folks to connect with. That is just straight up disrespect! I have asked them to remove our affiliated content as well as SCM. It doesnt have to go past plain ol disrespect with our community, but they feel the need to, and it is sad when folks dont see it for what it is….. the logo on popeyes forearm….

thank you for seeing how “XXX Artists & Albums” looked wrong as a title, and changing it last night on your website. Either they, you realized it looked wrong and changed it and/or talked with your lawyer, who backed up my claim about the new copywrite (I got to spend 1/2 of my retainer to find that out) law. Either way, my point is the manner in which you do things…not so much that you do it. This is a prime example of just one of the things that XXX has mishandled. There is no “Keith you are right, thanks for pointing that out”….
Also, if you honestly mean so well, whynot ask permission to display our imagry without any kind of depth or due recognition? We are working hard to release our official statement about all of this….one that is truly from our heart, that we are taking a lot of care… in it’s presentation. We hoped the communal uproar would actually be addressed, and not shoved aside while y’all continue to do so. Not until my post, did you realize that “XXX Artists & Albums” looked wrong, and you changed it. Did you come to think that there is the possibility that title was only one stepping stone to the next issue? Offering the willingness to change the XXX name but continuing to release as “XXX”, is making anything y’all say…not too believable, or trustworthy. Motive & intent are beautiful things to understand. Anyways, I appreciate you changing the title on your website above the albums, there are artists & labels I still care about in there….. but seriously, “good on ya” for taking my suggestion & changing the site to read & represent what you are doing better. Hey Folks,
Hope everyone enjoyed the long weekend! In the spirit of independence, I’d like to take a minute to address… well, independence. As you know we run an independent label. In the 7 years we have had this team together, for better or worse, we have had a clear idea of our mission since day one. Every ounce of articulated press from the archive to date, compliments the ideas that got us started and the actions we take that keep us running with the same amount of steam our founders barreled into our creation.
It’s a good deal we’ve got. Promoting what we love, on our own terms for the sake of the music that changed us when we found it, drew us in as individuals and pulled us together. If you have the means I highly recommend it. Whatever you love, you are not alone and there is no better time than now to organize and find an audience to support it with you.
All of us that work in this industry on an independent level have our own views on the society that wired our motives to spotlight whatever frame we built. The “mainstream” has always been run on the buck and now more than ever the generic hit rotisserie files into the five approved genres and cranks out minty fresh sound cubes to the digital breadline of consumers celebrating their individuality through their marketing demographic. That’s a bleak dystopian angle but thankfully only a portion of a free market. As long as we have the power of cultural autonomy the music industry version of Soylent green doesn’t have to have anything to do with us.
If you follow the message boards on Saving Country Music and No Depression, you have a head start on where this is going. We have hit a crux on the political side of business and some tough decisions have been made. What should have been a private and brief conversation between Adam Sheets of XXX and Keith here at HBE hit the bike racks of the board and sparked a public dialogue that we now have no choice but to acknowledge. It aint’ pretty. On a business level, I’d love to call a spade a spade close the door on the badger den and go back to work, but it has gone to far now.
It came to our attention that our logo and a few of the artists we represent were listed throughout the XXX site in a way that made it appear that we were directly affiliated. No one from XXX had approached us prior to this. No glove slap, just a matter of principal we were within our rights to make note of. When we called on them to remove the images only part of our request was granted and the conversation didn’t go well, a good portion of which can be found on the SCM public forum. The feed back from the posts had some common themes ; ‘What’s the big deal as long as the artists are being promoted?’ ‘This argument is pointless’ ‘We are all in this together, why can’t we just get along?’ I’ll tell you. Not all promotion is good promotion when it compromises the continuity of our philosophies concerning the greater good. This requires some looking into.
First of all, yes our primary goal is promoting our artists through the HBE cause but the company and artists are not interchangeable. That being said, this is an issue strictly between labels and the observations that follow are separate to the company itself. We do our best to work for our artists but make no attempt to speak for them. In the same turn our choice to draw a thick line between ourselves and XXX as entities falls under conflict of interest between ourselves and XXX’s proprietors and not the artists they carry. Our instincts led us to be wary of XXX from the beginning and through revelations over a short amount of time our notions were consolidated and confirmed. We will get to some of the statements that led to this but first let us tell you what this isn’t about.
We don’t care what XXX calls itself. Weather the moniker conjures ties with porn, moonshine or x-treme snack chips makes no difference to us outside of opinion. Hell, as far as logos having offensive implications one of the main images we use is a middle finger. However in our case there was never any doubt as to the message the symbolism carries.
We don’t care about the general career connections or family influence or monetary advantage Shooter inevitably brings to the XXX table. The closing line in Shooters post to us on SCM was ” If you really believe music is better without XXX then we can ask the people, but from the amount of positive responses i’ve gotten from my radio show, I really don’t think thats the case.” Great Shooter Having a radio station is an excellent way to have listeners. You should use every tool you have to move your agenda. We don’t have a radio station. We don’t have any of that. You win. We are a small operation but we are here. We’ve been here. The sudden X-posure of XXX coming in quick with the interest of representing the “underdog” might have sank in a little better with us If they had put the horse before the cart.
Ultimately it breaks down to opposition of mission and method. All over XXX is the desire to put a pretty extensive and varied list of bands that are “Too rock for country, to country for rock!” into the pantheon of media that has its back turned on them. “We want our own genre.” “Sign the petition!” “We want the same for XXX that every piece of slop that gets played in other genres gets!” ……………………..Woah. Sounds like ‘meet the new boss to us. We don’t need a boss and I can die just fine without my favorite songs on the top 40 chart. God speed XXX but that aint our fight.
XXX came out with their first compilation yesterday morning. Southern Independent XXX Volume One. With it came a “Warning- This album is intended to ruin the sanctity of roots music. By downloading and or listening to the material herein you are actively contributing to its demise. Despite this it is expected that you will fucking love it.” I could keep citing examples of why XXX doesn’t work for us, even have a good time on a personal level bashing Shooters “Southern Family Anthem” track, but in a predictable twist It has done that on it’s own in a neatly wrapped package. Way to steal my journalistic exposition thunder XXX. Again, though its a mix mash I wouldn’t have thrown together, the XXX roster has some great bands that despite their new powerhouse endorsement, I will continue to buy their albums and attend their shows. Its not necessary to choose sides when it comes to the music, or the lables for that matter we just wanted you to know where we stand. Any and all feedback is more than welcome and if there are things I may have overlooked in my conclusions please, have at it. Till next time Amigos

Here is the thing man, you were asked for your input from the very beginning. You have a label that has artists on it. Shooter and Adam are just trying to help spread the word about the underground scene.
It is very unfortunate that your unjustified hate for Shooter will not let you see the good he and Adam are trying to do for these bands that find themselves on the outside looking in, like your acts are.
When Shooter was just trying to make a name for himself, you and others bitched that he was riding his family name. Now he is lending his name to help others out and nuts like you still bitch about it.

There is no such line.

I just corresponded with Keith, and it seems he made an honest mistake and is taking responsibility for it. Adam Sheets said that SCM doesn’t cover the majority of XXX artists, when by Adam’s own numbers, I have covered 17 of the 27 he listed. So this goes both ways. Keith’s statement was stimulated by the warning put on the comp. I will not stand here and defend all of Keith’s actions, but that warning was pretty immature, and they could only have anticipated getting a strong reaction from him. And I don’t know where I am following Keith around. The only reason I commented on No Depression is because Adam Sheets was making a concerted effort to smear the name of SCM.
Look, this is like the Palestinians vs. the Israelis. Everyone’s pissed off, there’s tons of bad blood, and there’s blame to be had on both sides. Don’t act like all the blame to be had is one-sided.
And I am not ignoring the comp BTW. I just heard it for the first time today, because on the 4th I was wrapped up with Willie Nelson’s Picnic. But honestly, in this polarizing environment, I don’t know if I want to say anything about it. It could only lead to more turmoil.

@ Nathan 1st, thank you for bringing that up about the line in that song. I did post an honest mistake and apologized for it on that FB thread. Thats a shitty mistake, but I wasnt spreading LIES…. you really have to dig to find the one thing… I appreciate that.
Other than that, Trig is right. Your agument and and defense only puts us back at the starting line. We made our stance above from Headquarters and I am pretty sure, thats where it ends with Shooter. We all know it.
